Privacy Policy

Mist.ai respects your privacy. This Privacy Policy explains how we collect, hold, use, disclose and protect personal information, and how we comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
1. Who we are
In this policy, “Mist.ai”, “we”, “us” and “our” refer to the partnership trading as Mist.ai, based in Perth, Western Australia. Mist.ai provides a software platform that gives Australian trades and service businesses (our “Clients”) an AI assistant and customer-relationship tools to capture leads, schedule jobs, send invoices and manage their customers.
This policy applies to personal information we handle as a business — for example, information about our Clients, prospective Clients, and visitors to our website at mistai.com.au.
2. Information we collect
The kinds of personal information we collect depend on how you interact with us:
If you are a Client (or a contact at a Client business)
- Identity and contact details — name, business name, email address, phone number, business address;
- Account details — login email and password, business profile, services offered, team member details you add;
- Billing information — subscription plan and billing records. Card payments are processed by Stripe; we do not store your full card number on our systems;
- Content you create in the platform — jobs, quotes, invoices, customer records, calendar entries, notes and settings;
- Usage and technical data — log data, IP address, device and browser information, and how you use the platform.
If you are a visitor or prospective Client
- Any details you provide when you contact us, request a demo, or chat with the assistant on our website (such as your name, email, phone and your message).
We generally do not collect sensitive information (as defined in the Privacy Act). Please do not submit sensitive information to us unless it is necessary and you consent to us handling it.
3. How we collect it
We collect personal information directly from you wherever practicable — for example, when you are onboarded as a Client, create or update your account, contact us, or use the platform. We may also collect it automatically through cookies and server logs when you use our website or the platform, and occasionally from third parties such as our payment processor or an integration you choose to connect (for example your accounting or calendar provider).
4. Why we collect, hold and use it
We collect, hold and use personal information to:
- set up, provide, maintain and improve the Mist.ai platform and its features;
- create and administer your account and verify your identity;
- process subscription payments and manage billing;
- provide customer support and respond to your enquiries;
- send you service-related messages (for example onboarding, security, billing and important notices);
- generate analytics and reports for your business;
- protect the security and integrity of our systems and detect or prevent misuse, fraud or unlawful activity; and
- comply with our legal obligations.
5. Personal information you collect from your own customers
When you use Mist.ai as a Client, you will collect and store personal information about your customers and prospects (for example their name, phone number, email, address and enquiry details captured by the AI chat widget). In relation to that information:
- You are responsible for that information and for complying with your own privacy obligations, including having a lawful basis to collect it and providing your own privacy notice to your customers where required.
- We act as a service provider, processing and storing that information on your behalf and under your instructions, solely to provide the platform to you.
- We do not sell your customers’ information, and we do not use it for our own marketing.
You must only use Mist.ai’s messaging features (such as SMS, email and review requests) in compliance with applicable laws, including the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth), and you must have the necessary consents.
6. Who we share it with
We do not sell personal information. We disclose it only as needed to run the service or as required by law, including to:
- Service providers who help us operate Mist.ai, such as our cloud hosting and infrastructure provider, payment processor (Stripe), email delivery (Resend), SMS and voice provider (Twilio), and our AI model provider (Google, for the Gemini model that powers the assistant);
- Integrations you choose to connect, such as Google Calendar, Xero or Stripe, where you authorise us to share data with them;
- Professional advisers (such as accountants or lawyers) where reasonably required;
- Government, regulators or law enforcement where we are required or authorised by law; and
- A buyer or successor in the event of a sale, merger or restructure of our business.
We require our service providers to protect personal information and to use it only for the purpose we engage them.
7. Overseas disclosure
Some of our service providers store or process data outside Australia. In particular, providers such as Stripe, Twilio, Resend and Google (Gemini) may process information in the United States and other countries. Where we disclose personal information overseas, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles, including by using reputable providers with appropriate data-protection commitments.
8. Direct marketing
We may send you marketing communications about Mist.ai where you would reasonably expect it or where you have consented. You can opt out at any time by using the unsubscribe link in any message or by emailing us at hello@mistai.com.au. We will always send you service and account messages that are necessary to provide the platform.
9. Cookies & analytics
Our website and platform use cookies and similar technologies to keep you signed in, remember your preferences, and understand how the service is used so we can improve it. You can control cookies through your browser settings, although some features may not work without them.
10. How we store and protect information
We hold personal information in secured systems and take reasonable steps to protect it from misuse, interference, loss, and unauthorised access, modification or disclosure. These steps include encrypted connections (HTTPS), access controls, hashed account passwords, and hosting on infrastructure with persistent, access-controlled storage. No method of transmission or storage is completely secure, but we work to protect your information and to respond promptly to any data breach in accordance with the Notifiable Data Breaches scheme.
11. How long we keep it
We keep personal information for as long as we need it to provide the service and for a reasonable period afterwards to meet legal, tax and accounting obligations or to resolve disputes. When information is no longer needed, we take reasonable steps to delete or de-identify it. If you close your account, you may request export or deletion of your data as described in section 12.
12. Accessing and correcting your information
You may ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date or incomplete. Much of your information can be viewed and updated directly in your account. To make a request, contact us using the details in section 16. We will respond within a reasonable time and may need to verify your identity first. There is generally no charge, although we may recover reasonable costs for some access requests. If we decline a request, we will tell you why.
13. Complaints
If you have a concern or complaint about how we have handled your personal information, please contact us first at hello@mistai.com.au and we will work to resolve it. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or on 1300 363 992.
14. Children
Mist.ai is a business tool intended for use by businesses and is not directed at children. We do not knowingly collect personal information from children.
15. Changes to this policy
We may update this policy from time to time. The current version will always be available at mistai.com.au/privacy, and we will update the “Last updated” date above. If we make a significant change, we will take reasonable steps to notify you.
